TERMS OF SERVICE

1. INTRODUCTION
Welcome to Retreat and Rest (“we,” “our,” “us,” or “Company”), located at Churchman Island, Saskatchewan S0J 1L0, Canada. These Terms of Service (“Terms”) govern your access to and use of retreatandrest.com (“Website”) and our retreat services (“Services”).
By accessing or using our Website or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Services.
2. DEFINITIONS
- “Retreat”: A 3-4 day event organized by the Company featuring expert-led sessions in various fields of expertise.
- “Participant”: Any individual who registers for and attends a Retreat.
- “Expert”: A presenter, speaker, or instructor who provides insights in their field of expertise during a Retreat.
- “Registration”: The process of booking and paying for attendance at a Retreat.
3. REGISTRATION AND ELIGIBILITY
3.1 Eligibility
To register for our Retreats, you must be at least 18 years of age and possess the legal authority to enter into a binding agreement.
3.2 Registration Process
- Registration is complete only upon full payment.
- All registrations must include accurate and complete information.
- By registering, you confirm that all provided information is true and accurate.
3.3 Payment Terms
- All fees are quoted in Canadian Dollars unless otherwise specified.
- All applicable taxes will be added to the final payment amount.
4. CANCELLATION AND REFUND POLICY
4.1 Cancellation by Participant
- Cancellations made 30 days or more before the Retreat start date: Full refund minus a 10% administrative fee.
- Cancellations made 15-29 days before the Retreat start date: 50% refund.
- Cancellations made 8-14 days before the Retreat start date: 25% refund.
- Cancellations made 7 days or less before the Retreat start date: No refund.
4.2 Cancellation by Company
- If a Retreat is cancelled due to insufficient registrations (less than 10 participants), all registration fees will be fully refunded.
- The Company reserves the right to cancel a Retreat for any reason, including but not limited to Force Majeure events, in which case all registration fees will be fully refunded.
- The Company shall not be liable for any additional expenses incurred by Participants in relation to a cancelled Retreat, including but not limited to travel expenses, accommodation, or any consequential or indirect losses.
5. LIMITATION OF LIABILITY
5.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
5.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.
THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
6. PARTICIPANT CONDUCT AND RESPONSIBILITIES
6.1 Code of Conduct
Participants agree to:
- Behave in a respectful manner toward Experts, other Participants, and Company staff.
- Comply with all applicable laws and regulations.
- Follow all rules and guidelines provided by the Company during the Retreat.
- Respect the facilities and property where the Retreat is held.
6.2 Health and Safety
- Participants are responsible for disclosing any relevant health conditions or dietary restrictions during registration.
- The Company is not responsible for any health issues that arise during the Retreat if not previously disclosed.
- Participants must have appropriate health insurance coverage for the duration of the Retreat.
6.3 Personal Property
The Company is not responsible for any loss, damage, or theft of personal property during the Retreat.
7. CONTENT AND INTELLECTUAL PROPERTY
7.1 Retreat Content
All materials, presentations, and content provided during the Retreat are the intellectual property of the Company or its Experts and are protected by copyright and other intellectual property laws.
7.2 Use Restrictions
Participants may not:
- Record, photograph, or otherwise capture presentations without prior written consent.
- Reproduce, distribute, or create derivative works based on Retreat content.
- Use the Company’s or Experts’ names, logos, or trademarks without prior written permission.
8. PRIVACY
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information.
9. MODIFICATIONS TO TERMS
The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Website. Your continued use of the Services after any modifications indicates your acceptance of the modified Terms.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
10.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the Services shall be resolved through:
- Good faith negotiation between the parties.
- If negotiation fails, mediation in Saskatchewan, Canada.
- If mediation fails, binding arbitration in Saskatchewan, Canada, in accordance with the Arbitration Act of Saskatchewan.
11. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
12. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings, whether written or oral.
